These Terms and Conditions (Terms) govern the use of the medicaldocu.com platform operated by Lakeside Health AG (MedicalDocu) by registered users.
The contracting party is Lakeside Health AG, Hauptstrasse 39, CH-8280 Kreuzlingen.
By registering or using the platform, the user accepts the then-current version of these Terms.
MedicalDocu provides a cloud-based software-as-a-service solution to support medical documentation, in particular the creation of medical letters, reports, templates and speech-to-text transcription.
The platform is a tool; it does not replace medical judgement, nor does it relieve users of responsibility for the substantive accuracy of the documents produced.
MedicalDocu is not a medical device within the meaning of medical device regulation and is expressly not offered for diagnosis or therapy recommendations.
The platform is intended exclusively for medical professionals, practices and institutions in the healthcare sector.
Use by private individuals outside a professional context is not envisaged.
Use of the platform requires registration with truthful information.
The user must keep access credentials confidential and protect them from unauthorised access.
MedicalDocu may temporarily suspend access if there is reasonable suspicion of misuse.
The specific feature set is determined by the then-current product description and the licence plan chosen by the user.
MedicalDocu continually develops the platform and reserves the right to add, change or – while preserving users' legitimate interests – discontinue features.
Features marked as beta or preview may be available only to a limited extent.
The user ensures that they are entitled to process the patient data entered and that all necessary consents and professional prerequisites are in place.
The user is responsible for the substantive accuracy, completeness and medical correctness of the documents produced.
The user undertakes not to use the platform in an abusive, unlawful manner or for purposes outside their professional context.
Sharing access credentials with third parties outside the user's own practice is prohibited.
Use of the platform is based on the licence plan agreed between the parties. The applicable prices and feature scope are disclosed during ordering or in an individual agreement.
Unless otherwise stated, all prices are exclusive of statutory value-added tax.
Unless otherwise agreed, the contract runs for an indefinite period and may be terminated by either party with 30 days' notice to the end of a month.
The right to extraordinary termination for good cause remains reserved.
MedicalDocu aims for the highest possible availability of the platform but, in the absence of an express written agreement, does not owe a specific service level.
Planned maintenance is performed outside usual practice hours where possible; unplanned interruptions to address security-relevant events remain reserved.
MedicalDocu is liable in accordance with statutory provisions for intent and gross negligence as well as for personal injury.
Liability for slight negligence, consequential damages, lost profits, data loss or third-party claims is – to the extent permitted by law – excluded.
In particular, MedicalDocu assumes no liability for the medical accuracy or completeness of the content produced with the platform; final review and release remain the responsibility of the professional user.

All rights in the platform, the software, the design and the trademarks remain with MedicalDocu or its licensors.
Content entered by the user remains the user's property; MedicalDocu only receives the usage rights necessary to provide the services.
MedicalDocu may amend these Terms where there is a material reason and will announce changes in an appropriate form at least 30 days before they take effect.
If the user does not object within this period, the amended Terms are deemed to have been accepted.
These Terms are governed exclusively by Swiss law, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods.
The exclusive place of jurisdiction is, to the extent permitted by law, Kreuzlingen (Canton of Thurgau, Switzerland).
